Cancellation and Refund Policy
Indecimal (Hexindecimal Services Pvt. Ltd.)
Indecimal (Hexindecimal Services Pvt. Ltd.), a company incorporated under the provisions of the Companies Act, 2013, operates as a tech-powered construction facilitator redefining residential and commercial builds in India. Engagements pertaining to construction, interiors, and renovation services are facilitated by the Company through a consultative model involving End Customers and designated Contractors.
By means of the Indecimal platform, access is granted to both End Customers and Contractors for the purpose of reviewing project-specific information, tracking progress milestones, and ensuring transparency throughout the construction or renovation process. Apart from project coordination, assistance is extended by Indecimal in the domains of construction financing, quality assurance, real-time project reporting, and long-term maintenance support (AMC).
Engagement with the platform shall be deemed an acknowledgment and acceptance by End Customers and Contractors of the terms set forth under this Cancellation and Refund Policy.
Cancellation Policy
It is to be noted that substantial time, effort, and resources are expended by Indecimal in the process of assessing customer-specific requirements, preparing detailed design documentation, conducting site surveys, and liaising with third-party professionals.
Recommendations concerning project execution and contractor alignment are made subsequent to a comprehensive evaluation of various criteria, including but not limited to budget considerations, geographical location, design expectations, project timeline, and the historical performance of contractors.
By engaging our services, you acknowledge that you have read, understood, and agree to be bound by the terms outlined in this Cancellation and Refund Policy. Indecimal reserves the right to modify this policy at any time with appropriate notice to our clients.
In circumstances where an End Customer seeks to cancel or terminate an engagement subsequent to the payment of booking charges or at any progressive stage thereafter, such intent must be communicated by way of a formal written request.
This request must be submitted from the registered email address utilized during onboarding, addressed to support@indecimal.com, or dispatched via registered post/Speedpost with acknowledgment due.
The communication must clearly articulate the reasons for cancellation and be accompanied by relevant supporting documentation.
Until such formal written notice is received, the project shall be classified as active, and all corresponding services shall be considered billable. Any advance amount paid shall be appropriately adjusted against services rendered up to the point of cancellation.
Service Cost Recovery and Refund Structure
It is acknowledged that certain costs are incurred by Indecimal at various phases of the project, including site visits, technical evaluations, surveys, design development, and mobilization of resources. Upon receipt of a cancellation request, deductions shall be applied to the payment received, based on the services rendered. Additional recovery of costs may be executed via separate invoicing.
Cancellations effected subsequent to any payment transaction shall attract service charges as per the following structure:
The above charges shall be computed as a percentage of the Project Cost, defined as the baseline project valuation established by Indecimal.
This valuation shall be exclusive of any concessions, promotional offers, discounts, or temporary abatements and inclusive of applicable taxes.
The Project Cost shall serve as the reference value for all contractual and internal assessments and shall remain unaffected by negotiated pricing reductions.
Services not explicitly covered in the aforementioned scope shall be charged on actuals.
Refund Terms
In instances where cancellation is effected following execution of the definitive agreement/document, deductions shall be administered in accordance with the stipulations of the said agreement/document.
Design outputs or technical reports shall be provided only in accordance with mutually accepted terms and subject to completion of associated payments.
Expenses incurred by the Contractor beyond the scope of services rendered by Indecimal—particularly in relation to material mobilization—shall be invoiced directly by the Contractor to the End Customer. Disputes pertaining to such charges shall be resolved based on Indecimal’s final determination, which shall be binding.
Where a specific stage of the project has commenced, the full charge corresponding to that stage shall become applicable. Refunds shall not be permitted for partial completion of stages.
Outstanding Dues and Interest
In cases where the cumulative service cost exceeds the amount already paid by the End Customer, the outstanding balance shall be remitted within a period of 60 business days from the date of notification. In the event of delayed payment, interest at the rate of 18% per annum shall be levied from the original due date, if applicable.
Refund Processing Timeline
All eligible refunds shall be processed via electronic transfer (NEFT/RTGS) within a period of 60 business days following the execution of a duly signed Settlement and Release Agreement. No cash refunds shall be entertained.
Policy Revisions
Indecimal reserves the unilateral right to modify or amend the provisions outlined in this policy. Notification of such revisions shall be made available to all customers. Continued usage of the Indecimal platform shall constitute acceptance of the revised terms, which shall be considered final and binding.
In the event the project falls under the purview of the Real Estate (Regulation and Development) Act, 2016 (RERA), any requests for refund or cancellation shall be governed in accordance with the applicable provisions of the Act and the respective rules and regulations enacted by the relevant State Authority.
